Personal Injury Lawyer in Bellevue, WA
You were driving home on I-405, or crossing NE 8th St, when another driver hit you. You spent the night in the emergency room at Overlake. Now the pain hasn’t let up, the bills have started and an insurance adjuster wants a recorded statement. You’re not sure who to trust or what to say.
Elsner Law Firm, PLLC guides people hurt in accidents in Bellevue and across the Eastside, from the first insurance call to the day life feels normal again. We have represented injured people in Washington since 2007. Our new Bellevue office is at 1130 140th Ave NE, Suite 300K, close to where you live, work and get care.
Justin Elsner and his team take on the insurers, the paperwork and the deadlines. You focus on healing. We’re used to the claims that don’t fit a simple form: more than one car or insurer, a driver who blames you, an old injury the crash made worse, or PIP benefits that suddenly stop.
You don’t need to know the law or the insurance rules to get started. You only need to tell us what happened. We’ll explain what your own policy covers, what the other driver’s insurer may owe and what comes next.
Talking to a Bellevue personal injury attorney costs you nothing. Call (425) 409-0305 or request a free consultation. We work on a contingency fee, so there’s no fee until we recover money for you. Every case is different, and we’ll give you an honest view of yours.

Local Insight: Why Bellevue Injury Cases Are Different
Bellevue injury cases turn on local details: which streets see the most serious crashes, which agency wrote the report and how fast the city is changing. Those details shape how an insurer values your claim.
Serious crashes are rising. Bellevue’s Vision Zero program aims for zero traffic deaths and serious injuries on city streets by 2030. The city isn’t there yet. In 2024, Bellevue recorded 2 traffic deaths and 34 serious-injury collisions, the most in a decade. From 2015 to 2024, 22 people died and 232 were seriously injured on Bellevue streets, according to the city’s Vision Zero progress report.
The danger is concentrated. The city’s High Injury Network shows that 68% of fatal and serious-injury collisions happen on just 8% of the street network. You can look up where crashes cluster on the city’s Vision Zero pages. We use that data rather than guess at the “worst” intersection.
Light rail changed the streets. The Sound Transit 2 Line opened on April 27, 2024. It added stations at South Bellevue, East Main, Bellevue Downtown, Wilburton, Spring District and BelRed. New rail crossings and more people walking to stations change who shares the road. A pedestrian accident near a station can raise hard questions about signals, crosswalks and who had the right of way. Learn more about pedestrian accidents.
Who writes the report matters. Bellevue Police handle collisions on city streets. You can request a copy through the city’s Public Records Center. Crashes on I-405, SR-520 and I-90 are usually Washington State Patrol cases, and those reports come through the WSP’s WRECR system.
Why it matters to you. The report is often the first thing the insurance adjuster reads. If it leaves out a witness or gets a detail wrong, the insurer may use it to argue comparative fault and cut its first offer. We get the right report early and check it against photos, witnesses and the scene. Every King County claim starts with the facts, so we make sure they’re right. That matters most when fault is disputed or more than one driver is involved. A short delay can mean lost video from nearby businesses or a witness who can’t be found. Acting early keeps those options open, and it gives you a clearer picture before the insurer makes its first offer.
Dangerous Roads and Corridors in Bellevue
Most Bellevue crashes happen on a handful of busy roads. Knowing the road helps explain how the crash happened, who investigated it and what the insurer is likely to argue.
I-405: The Eastside’s Spine
I-405 carries traffic north and south through Bellevue all day. The Washington State Department of Transportation runs I-405 express toll lanes between Lynnwood and Bellevue from 5 a.m. to 8 p.m. on weekdays. There’s a direct-access ramp at NE 6th St in Bellevue. Vehicles over 10,000 lb are barred from the express lanes, so heavy trucks stay in the general lanes.
The claims we see here follow the traffic. Drivers merge into and out of the express lanes at different speeds. Stop-and-go traffic leads to rear-end crashes. Quick lane changes cause sideswipes. When several cars are involved, more than one insurer may point at someone else.
SR-520: The Bridge Commute
The tolled SR 520 Bridge links Bellevue and Seattle. Our office is about 1 mile from SR-520, so we know this commute well.
Congestion builds fast as traffic nears the bridge. Sudden slowdowns catch drivers who follow too closely or look away for a moment. These crashes often look simple, but injuries like neck and back strain can take weeks to show their full effect.
I-90: Factoria and Eastgate
I-90 runs along Bellevue’s southern edge, through Factoria and Eastgate toward Mercer Island and Issaquah. Commuters, freight and weekend mountain traffic share these lanes. Crashes here are typically Washington State Patrol reports, not Bellevue Police reports. That changes where your report comes from and who the investigating officer is.
NE 8th St and Bel-Red Rd
NE 8th St and Bel-Red Rd are the main east-west arterials near our office. They carry heavy traffic between downtown, the BelRed area and SR-520. Long signal cycles, turning traffic and people on foot all meet at the same intersections. A car accident here may involve a left turn, a red light or a pedestrian in the crosswalk. Our Bellevue car accident lawyer page explains how these claims work.
We describe traffic patterns here, not crash counts for single intersections. Where a number matters, it comes from the city or WSDOT. Wherever your crash happened, the questions are the same: what happened, who was careless and which insurance pays. We help you answer them with evidence, not guesses.
Where Bellevue Injury Claims Are Decided: King County Courts and Local Care
Most people never set foot in a courtroom after a crash. Still, it helps to know where your claim would go if the insurer won’t be fair, and why your medical care matters from day one.
King County Superior Court. Under King County’s LCR 82, Bellevue is in the Seattle Case Assignment Area. A Bellevue injury lawsuit filed in Superior Court is assigned to the Seattle courthouse, not the Kent courthouse. Claims above the District Court limit are filed here.
King County District Court. District Court hears civil claims up to $100,000 per claimant (RCW 3.66.020). The court has a Bellevue courthouse at 1309 114th Ave SE. Civil cases for this area, though, are filed and handled at the Redmond facility.
Overlake Medical Center. Overlake Medical Center, at 1035 116th Ave NE, is the Eastside’s first Level III Trauma Center. Many people hurt in Bellevue start their care there. Those first ER records matter. They show what hurt and when. Adjusters look for gaps in treatment and use them to argue you weren’t badly hurt. Going to follow-up visits and keeping your medical bills together helps close those gaps. Keep a simple record of missed work, too. Pay stubs and a note from your employer help prove lost wages later, when the insurer asks for proof you can’t easily rebuild.
Why this matters for you. Most claims end in a settlement without a trial. Knowing where a case would be filed still shapes how we prepare it and how seriously an insurer takes it. The statute of limitations also keeps running while you negotiate, so we track your deadline from the start. We can’t promise how any trial would turn out. We can make sure your claim is ready if it comes to that.
Personal Injury Cases We Handle for Bellevue Clients
Every injury is different, but the questions are often the same. Who pays? What does my insurance cover? What’s my claim worth? Here are the cases we help Bellevue clients with.
Car Accidents
Rear-end crashes, turning crashes and multi-car pileups often end the same way: an injury and an insurer who wants to settle fast. Our Bellevue car accident lawyer page explains your options after a car accident, including PIP and underinsured motorist (UIM) coverage.
Truck Accidents
A truck accident often means more than one insurer, a trucking company and federal driving-hour limits (49 CFR 395.3). See our Bellevue truck accident lawyer page.
Motorcycle Accidents
Riders are often blamed first and hurt worst. Insurers may claim you were speeding or hard to see. A motorcycle accident claim needs careful work on fault and coverage. Visit our Bellevue motorcycle accident lawyer page.
Pedestrian Accidents
When a driver hits someone on foot, injuries are usually severe. Your own auto policy may still pay benefits. Read about pedestrian accidents and your rights.
Uber and Lyft Accidents
Rideshare crashes raise a quick question: whose insurance applies? The answer can depend on whether the app was on and whether a ride was in progress. We help passengers and others hurt in Uber and Lyft accidents sort out coverage.
Bicycle Accidents
Cyclists share Bellevue’s arterials with heavy traffic and turning cars. We help injured riders deal with the driver’s insurer and with their own auto coverage, which may still help pay medical bills.
Dog Bites
A dog bite can mean stitches, scarring and fear that lasts. Payment often comes from the owner’s homeowner’s or renter’s policy. Some policies exclude certain dogs, so coverage needs a close look early. Learn more about dog bite claims.
Wrongful Death
Losing someone in a crash is devastating. Washington’s wrongful death law (RCW 4.20.010) lets certain family members bring a claim. We handle the insurers so your family can grieve. Learn about wrongful death claims.
Slip and Fall
A wet floor, broken stair or poor lighting can cause a serious fall. When an owner ignores a hazard, the harm it causes may be their responsibility. We look at what the owner knew and when. Read about slip and fall injuries.
Insurance Claim Denials (IFCA)
Sometimes your own insurer is the problem. If it unreasonably denies PIP or UIM benefits, Washington’s Insurance Fair Conduct Act (RCW 48.30.015) lets you sue. The court may award up to three times actual damages plus attorney fees. See our page on Insurance Fair Conduct Act claims.
Washington Laws That Shape a Bellevue Injury Claim
A few state laws decide how long you have, how fault is shared and which insurance pays. Here’s what applies to most Bellevue injury claims.
Your deadline. Washington’s statute of limitations gives you three years to file most injury lawsuits (RCW 4.16.080(2)). Three years sounds like plenty. But evidence fades, witnesses move and video gets erased long before then. Claims against a government add extra steps, covered below. If you miss the deadline, the court can dismiss your case, no matter how badly you were hurt.
Shared fault. Washington uses pure comparative fault (RCW 4.22.005). If you were partly at fault, your recovery goes down by your share, but you can still recover. When several drivers or companies are involved, fault is divided among them (RCW 4.22.070). That’s why multi-car crashes need careful work. Read more about Washington’s comparative fault law.
Claims against the city. If a City of Bellevue vehicle or a road defect played a part, the rules change. You must first present a claim to the city or other local government. Then you must wait 60 calendar days before you can sue (RCW 4.96.020).
Insurance basics. Washington drivers must carry at least 25/50/10 liability coverage (RCW 46.30.020, RCW 46.29.090). That means up to $25,000 for one person’s injuries, up to $50,000 total for everyone hurt in the crash and $10,000 for property damage. That’s often not enough for a serious injury. Insurers must offer personal injury protection (PIP) with at least $10,000 in medical benefits (RCW 48.22.095, RCW 48.22.085). They must also offer underinsured motorist coverage (RCW 48.22.030). Both are part of your policy unless you rejected them in writing. Many people wonder if Washington is a no-fault state. It isn’t, which is why PIP and liability claims work side by side. PIP often pays your first medical bills while the fault claim is still open. Later, the at-fault driver’s insurer may owe the rest. If that driver’s limits are too low, your UIM coverage can help fill the gap. Keeping these claims in order is one of the main things we do for you.
No cap on pain and suffering. In ordinary injury cases, Washington doesn’t cap noneconomic damages like pain and suffering. The state Supreme Court struck down the cap in Sofie v. Fibreboard Corp., 112 Wn.2d 636 (1989).

Bellevue Personal Injury FAQs
Here are short answers to questions we hear from people hurt in Bellevue.
How much does a personal injury lawyer in Bellevue cost?
Our Bellevue personal injury attorney team works on a contingency fee. You pay nothing upfront, we front the case costs, and there’s no fee until we recover money for you. We explain the fee and case costs in writing before you sign.
How long do I have to file an injury claim in Washington?
Under Washington’s statute of limitations, you have three years to file most injury lawsuits (RCW 4.16.080). For claims against the City of Bellevue or another local government, you must present a claim first and wait 60 days before suing (RCW 4.96.020).
What if I was partly at fault for a crash in Bellevue?
You can still recover. Washington uses pure comparative fault (RCW 4.22.005). Your recovery goes down by your share of the fault, but it doesn’t disappear. Insurers often push your share too high, so we check the evidence.
Should I give a recorded statement to the other driver’s insurer?
It’s usually wise to wait. You don’t have to give the other driver’s insurer a recorded statement. Adjusters use your words to downplay injuries or shift blame. Give only basic contact facts, and talk with someone on your side first.
Where would my Bellevue injury lawsuit be filed?
Most Bellevue injury lawsuits go to King County Superior Court. Under LCR 82, Bellevue is in the Seattle Case Assignment Area, so the case goes to the Seattle courthouse. Smaller claims, up to $100,000 per claimant, can go to King County District Court, which handles this area’s civil cases in Redmond.
Does Washington cap pain and suffering damages?
No. Washington doesn’t cap pain and suffering damages in ordinary injury cases. The state Supreme Court struck down the cap in Sofie v. Fibreboard Corp. in 1989. What your claim may include depends on your injuries and how the crash changed your daily life.
